[ Acid] While I will always defend a copyright owner’s right to receive appropriate payment for access to his/her material, it’s nice to see someone standing up to the bully tactics of the RIAA. This blog is a commentary by the (EFF-backed) lawyers for Patricia Santangelo, who has refused to settle with the RIAA over filesharing which took place from her computer (although there are some interesting issues around that if you read through the site).

A blog doesn't need a clever name: As my EFF colleague Danny O'Brien dryly observes, it looks like the RIAA isn't very happy with its performance in court in the Patricia Santangelo case. It's asking for a second try up at bat. (via Cosmos)
Copyfight: I would say that asking for a second oral argument is unusual, because (a) in almost 31 years of working in litigation I’ve never heard of anyone doing it, and (b) the very asking for it is an admission that the first oral argument was lost. (via Cosmos)

halfcrazed: Apple seems to be sticking to it’s iPods as revenue streams, and yes, they ARE innovating with the iPod - OMG the iPod nano black is freaking beautiful - but aside from music products, there’s not a lot of new stuff. At most the Mighty Mouse, and that ain’t so new either, and perhaps the Mac Mini, which is old news. (via Cosmos)
James Governor's MonkChips: There are instructive parallels in the way that the auto is "baked in" to our economy by government sanction in ways that railroads are not. Gasoline taxes "fund" highway maintenance and development while any investment in railroads is a "subsidy." I don't know the history, but it's clear that the auto industry managed to finagle a situation where the government collects taxes to fund its infrastructure requirements. (via Cosmos)
Recording Industry vs The People: Through the Electronic Frontier Foundation we and our firm have undertaken to represent people in our area who have been sued by the Recording Industry Association of America (RIAA) for having computers whose internet accounts were used to open up peer-to-peer file sharing accounts. [Blawgzine.com] “Bloggers Legal Guide” Aims To Help Bloggers Understand, Defend Their Rights: Kurt Opsahl, an attorney for EFF and one of the project heads says he hopes the guide offers bloggers a better understanding of their rights and how to defend them. “The goal here is to give bloggers a basic roadmap to the legal issues one may confront as a blogger, to let bloggers know their rights, and to encourage them to blog freely with the knowledge that legitimate speech is protected.”
[Apanthropinization] Where are the neocons now when Corby needs them?: I'm not sure if the Australian system is guilty until proven innocent but she would have at least gotten a competent judge who, presumably, would have allowed her to gather evidence and to hear the merits of the case. If her fingerprints were not on the bag and someone else's were, that would go a long way towards establishing guilt or innocence.
