Pierce Law IP News Blog: In the second RIAA lawsuit story of the week, P2pNet is reporting that a lawsuit has been filed against a 14 year-old in Michigan. Originally the lawsuit was directed at the mother, claiming she was indirectly liable for providing her daughter with a computer. (via Cosmos)

[lawnorder] GMSV: Confess, child, or you will never see the one you call mother again: The subject of the investigation actually was Chan's then 13-year-old daughter, Brittany, aka "Spicybrnweyedgirl." According to a p2pnet report, when Chan refused to settle on behalf of her daughter, the record companies regrouped and now want to go after the teenager directly -- but first they want the court to push Mom aside and appoint a legal guardian in this matter.

Where Only the Wrong Survive] HBO doesnt want foozles borrowing digital content.: I take full responsibility for my actions and knowingly understand the risks, however, it is asinine and ludicrous on HBO’s part to spending an exuberant amount of money and effort on security prevention by issuing cease and desist orders alone and basically using stalking scare tactics when they could be devising and implementing an intermediary means of offering an alternative method for their content via online distribution.
[the musings of Brandon Jaynes] RIAA Loses Case Against 13 Year-Old: In order for the RIAA to sue the child, a Guardian Ad Litem (guardian appointed by a court to represent a minor) must be appointed to protect the interests of the child. While the mother had no experience or knowledge with computers, the RIAA claimed that she was indirectly liable for allowing her daughter to use her computer to illegally share music online.
[Todays Democracy : News, Feature Stories, Entertainment, Business, Science & Technology] Goliath takes a body blow - RIAA case Dismissed: In an ongoing case in Michigan Federal Court, the RIAA was forced to withdraw their case against Candy Chan. Candy Chan, who had no experience or knowledge of computers, has 13 year old daughter and may have had a file sharing account.
[Digitalmusicnews.com] Digital Music News: Insider Blogs: Chan attorneys fees, holding that in his opinion plaintiffs' lawyers had "taken reasonable steps to try to prosecute this case and litigate against the proper defendants" and that "[t]o the extent Candy Chan has incurred legal fees in this action, such fees are primarily the result of tactics designed to imped the ability of Plaintiffs to prosecute this action in an efficient manner" and because "Candy Chan has not agreed to fairly simple mechanisms which would accomplish the same objectives that the filing of motions has accomplished." http://info.riaalawsuits.us/priority_chan/chan_order_1.pdf

[Bigblog.com] Search: Teenager foils RIAA P2P lawsuit @ Big Blog: yfarren writes "According to cdfreaks.com the RIAA has lost the case against the mother of a 13 year old girl accused of file-sharing violations." From the article: "The case was dismissed with prejudice, which prevents the case from being advanced against the defendant. Finally, the RIAA tried asking the Judge to amend the judgment in order to allow them to sue the child through a Guardian Ad Litem.
